I’ve previously written about this event and won’t revisit it now. In short, the company fought back, winning an important court battle against the legal firm that had brought the lawsuit against Cellceutix. I think it was obvious that the firm did so at the behest of those behind the short attack. Unfortunately, though the company won on every issue of fact, the court didn’t award damages. Cellceutix’s reputation was intact, but it was an expensive effort that left the company weakened.
This is due, in my opinion, to a flaw in the US legal system. Many other countries routinely award costs and damages to victims of unethical lawfare. That’s not the case in the US. Another major flaw in our system is the SEC’s apparent disregard for short attacks and the tools they use, such as naked shorting.
