John, When a company is suspended by the SEC, brokers’ quotes are removed as required by the suspension. For them to be re-entered, a broker would need to apply with FINRA by filing a Form 211. Posting an attorney letter has no effect on the re-entry of quotes. FINRA must clear a 211 before a quote can be re-entered.

Message: I would like to know on stocks that were suspended by the SEC for 10 days like KMAG and BZRT , and who are now trading in the GREY Market an you have stopped posting quotes for them due to questionable activites can post an Attorney's Letter with respect to current information on you site. And more specifically in that letter that state that no officer, director, or 5% or more shareholder to the best of their knowledge is currently under investigation for past or current violations. Both or these companies got suspended the same day by the SEC and both have a current letter from their Attorney. Brandon, My question is not regarding quotes it is regarding the Attroney's letter which both KMAG and BZRT currently have posted on your website. Specifically how can they say this "And more specifically in that letter that state that no officer, director, or 5% or more shareholder to the best of their knowledge is currently under investigation for past or current violations, or in violation of nay state or federal securites law. And obviously that is why the SEC suspended them and their legal counsel must know that yet they give otcmarkets.com a current letter. How is this possible, since you or I have seen nothing from the SEC or FINRA clering either KMAG or BZRT?

We can’t speak for “no longer”. The letter only states that “currently”, the issuer is not under investigation.
At the time that the letters were made, we’ve determined that there was no investigation related to the prior suspension.

I have no reason to assume that SEC action is pending on this company or any other company. If there is action pending against this or any other company, we would not know about it before you or anyone else. The SEC publishes litigation releases on their website, www.SEC.gov which is where we look to keep an eye out for these actions. We do not get information before hand.
