Grasshopper, in this stage in the case you have to break the case down into three different J&J groups. The first group is made up of J&J's trial lawyers. They manage the case and are responsible for the implementation of the case strategy. This trial lawyer group still believes they can win outright on November 17 or at worst, win on November 17, knowing they will lose on appeal in the Federal Circuit Appeals Court in Washington, DC, but buy another 120 days at DECN's cost.

The second group consists of J&J's internal legal department tasked with managing the legal affairs of the Lifescan division. This group is actually the group of people who give J&J their terrible "bully, dishonorable" reputation. They would view a pre-November 17 settlement negotiation as too soon... "we don't owe those asshole pretenders anything." This group is headed up by a fellow named Timmons. Ultimately he's the guy who authorizes a top end settlement amount . This guy is a world class butthole. I dealt against him in a litigation with my former employer, a litigation that was about as clear as dirt but dragged on for 7 years anyway, with an initial verdict, followed by two appeal reversals, a new trial, another verdict and another appeal. The litigation cost my company almost $100 million. Interestingly for some reason Timmons cannot figure KB out. He thinks KB is crazy.

KB doesn't bully easily, and when he doesn't have the $$ to battle on, he does the work himself to stay in the game. That happened in the first J&J litigation where KB did most of the technical work after Shasta switched sides.

The third group is the upper management at J&J's Lifescan division. This is the group most affected by any settlement because their P&L is directly hit when J&J pays money. This is a group of about 15 people, and if J&J settled before November 17 they would lose their management bonuses. Some would join their 1500 former colleagues on the street. These guys would only agree to a reasonable settlement with a gun held to their heads. They would be a big fat NO! until the very end. But then again the end could come early next year so you never know. We also don't know how much pressure this group of "businessmen" are under to settle the case somehow so J&J can sell-off the Lifescan division.

This case and its ultimate settlement is best left to the courts at the moment. I don't think the judge will rule from the bench on November 17, but I do believe he will have a lot to say and most of what he says will be to push J&J into court ordered mediation with his words ringing in their ears, followed by a delayed written ruling (December-January) coming after the mediation and in my humble opinion after a settlement orchestrated by a Federal Magistrate both sides know and trust. And since it isn't an election year (a truism if there ever was one), DECN will fare well, not $400 million, not $100 million, but very well indeed.

Here are a couple of other thoughts. I have convinced KB as have others, to publish the Quarterly Report on time and not wait until the hearing. There will be a couple of things in that Quarterly Report, I think that might just identify that new partner everyone is asking about since the IVD world is awash with rumors. This partner is going to buy GenPrecis sight unseen. And, J&J is about to find out about another litigation front that will double Amazon sales thanks to a "friend" in Brooklyn, NY.

Lots of industry eyes on DECN.

Two more things. First, I don't give a chit what the Johnny Come Lately TAUG thug bashers say on this board about me.
