I cannot imagine why a settlement would be conting

I cannot imagine why a settlement would be contingent on the company being able to prove it's process regarding plastic to oil.  That was in no way the subject of the SEC complaint.

I can fully understand if it takes months to "paper" a settlement that has been agreed to -- if, in fact, there is an agreement.  I have no idea as to whether there has been or not.
