Too bad. The concept is very easy to understand.
This is my last post, so when I push the button, this is a good bye. All of the geniuses on this board can then talk all about share price. and bash KB because someone has to be to blame for shareholders' stock buying decisions.
In my humble opinion, when share price is all that is important, the posters become disconnected from the company and business DECN. Some never cared and it was always about share price. Nonetheless zeynoc I will explain the FDA issue for you.
DECN is demanding $400 - $700 million from J&J. Part of that demand results from a well founded belief that DECN's patents are being infringed by J&J's OneTouch Ultra and OneTouch Select diabetic test strips. OneTouch Select only sells in international markets. How stupid is that plan? Why would anyone sell a product internationally without developing a domestic market. Stupid, stupid, stupid. But for all of that stupidity J&J can be dumb all they want and continue to collect $300 million each year from primarily third world buyers for their OneTouch Select products. But I digress.
I have read all of the pleadings in four Federal lawsuits between DECN and J&J. Throughout all of those 6+ years of pleadings, J&J has played their message board theme: DECN sucks. Mr. Berman is a crook. DECN shareholders hate DECN, so any customers DECN has probably hate them too. DECN has no money and what money they do have was extorted from shareholders. Of the almost 700 Federal filings in these four Federal lawsuits, roughly 475 were filed by J&J and within all of those documents, the iHub message board opinions of DECN are manifest.
And now we come to Monday. Dr. Zem posted that there will be a hearing in Nevada Federal court. That much unfortunately is not true. At a hearing the lawyers, principals and attendees can see how the judge reacts to the pleadings and the oral arguments. At a hearing the judge might just dismiss the J&J Motion and force the litigants into Mediation. But alas, that is not the case. J&J will file their pile of steaming poop, and the judge will take until proobably the end of October to rule. So, what is true is that J&J gets one more written shot at convincing the judge that DECN sucks, Mr. Berman is a crook. DECN shareholders hate DECN, so any customers DECN has probably hate them too. DECN has no money and what money they do have was extorted from shareholders. And that is it. One lonely chance to overcome impossible (at this stage) odds.
I know that J&J will fail at this attempt. The lawyers for both sides know. The judge and his clerks (the real review professionals) all know this and have already made up their minds. The case will proceed, and the parties will be ordered to Mediation.
But my share price paramount friend zeynoc. Do you think the outcome of the Motion will be acceptable to J&J? Their goal is to drag the case out, lower their exposure (they believe time and foot dragging lowers liability -- and they may be right). Monday begins the first BIG strategic event. J&J has known since August 28 they were going to lose the Motion, and all that goes with it.
Court rulings are very, very important. J&J is going to lose this one and this one is BIG, but J&J is still J&J. So, if J&J's plan is to paint DECN like message board posters do: DECN sucks, Mr. Berman is a crook. DECN shareholders hate DECN, so any customers DECN has probably hate them too. DECN has no money and what money they do have was extorted from shareholders, etc. etc. then they are not going to just give up. The court case may move to third gear, but J&J's goal of destroying DECN has not changed.
So here comes the BIG point. What can J&J do that would have the same desired effect. that is, what can J&J do to force DECN to spend big money to survive. What can they do? They can go directly to the post-market group at the FDA and twist them against DECN like on steroids. And that would have the biggest desired effect because the J&J complaints (read: lies) are totally confidential. And the FDA would be only too happy to help out J&J, because FDA people in their mid to late-30s always look to move from the colorless government directly to the private sector, and what better place to work than J&J.
Now zeynoc, you have your own views about how the world works. But in these matters I actually have first hand experience -- many times over. Do you understand THAT? This will become all about the DARK SIDE of the industry if J&J loses in court. Take it to the bank, count on it.
So, let's do whatever we can to force out the only guy who beat J&J and the J&J influenced FDA. and that, in the share price paramount world would be justice. Let's force out the CEO and focus on the share price for the 90 days the company would have to live. I truly hope one or more shareholders come in and take over the company. I am a retired guy and I can afford my loss on DECN stock, so I would love to be a voyeur if shareholders move to force KB out and focus the company on share price.
