R&G is moving at greater speed compared to BR in the infringement suits. The fact that the Massachusetts court recently adopted the Delaware courts language as posted about a week or two ago, which was followed by the BR infringers suddenly trying to get the case dismissed and Duo trying to reject the same language to be adopted in the three BR cases is very telling.
So, my take on the BR litigation, it's dragging but BR is looking to move forward and swiftly (no more delays). Especially now that the three infringers see that they are getting backed into a corner. Why would any defendant push off or delay taking depositions if they knew they were going to win? They wouldn't!!!
R&G is pushing hard and seems to be doing it with efficiency.
The noose is tightening for the infringers. I wouldn't want to be going against BR and R&G who are challenging the courts to move quicker and not slow down.
