The Markman results concerning the dispute between the parties regarding the construction of the terms (1) "host computer," (2) "access channel"/"first channel" and "authentication channel"/"second channel," and (3) "multi-channel security system"/"security system." My recollection is that the Court has agreed with SFOR's argument as to (1) and (3).
It is numbers 1 & 3 that is critical. And Ropes & Gray know this !
(1) "host computer OR the device that one uses to log into their (for example) bank account using username and password, at which time a second channel or authentication asks for additional verification...(2) access channel/first channel and authentication channel (same device) and (3) multi-channel another device per SFOR patent security system"/"security system" third channel.
Everyone knows using a second channel or multi-channel authentication on the same device is 100 % broken. That is why everyone is infringing on SFOR's patent by using (3) multi-channel OOB authentication.
