I don't expect DECN lawyers to wait the full time allotted to them to respond to the filing. They should be ready with a response much earlier.
I do. Regardless of the date DECN posts their opposition, J&J has until early - mid September to rebut the rebuttal. Why give J&J lawyers more time to think of arguments.
It is already very, very bad for J&J. Anytime a factual document (factual by definition -- Summary Judgments are trials on paper) are filed almost totally devoid of facts and the points and authorities are haphazard at best, and there is so very little used from J&J's star expert witness, and shots are taken dating back to 2013, it is time to sit back let this just play out. Despite what you may read on message boards, and today is class Action Suit Day and TAUG Pretender Day on iHub, DECN is in good hands with their lawyers.
I am thinking settlement in late January if the schedule holds and earlier if the judge calls J&J's bluff.
