The nonsense on the corrupt iHub message board aside, tomorrow J&J has a Hobson's choice to make in the litigation. Either they file a Summary Judgment that they asked for, and the trial judge denies it (because there are many issues of fact that can only come out in a trial) despite their arrogant posturing, or they don't file for Summary Judgment and look like jerks to the judge (to the point of leaving the judge to think that they practice the rule of the bigger fool).
Filing a Summary Judgment means J&J puts their case on trial, only the trial is on paper, not in a courtroom with witnesses and experts, and filing starts a clock ticking; while not filing a Summary Judgment starts a faster clock ticking toward settlement.
We probably won't find out which bad choice J&J chooses until Tuesday. But stay tuned.
