I attended a hearing in the first Lifescan case early in 2015. At the close of the hearing, which was very unfair to DECN, the two lawyers made their closing arguments. When it was J&J's turn, their lawyer got up and his entire closing argument went something like this: "Judge if you find in favor of 'them' you will be putting 2500 people out of work in your district. And Judge that will be on your back."
The irony is, aside from the fact that only 1500 Lifescan people worked in that Judge's district not 2500, was that less than 6 months later J&J put these 1500 people out of work by themselves, without any help from the Judge or DECN. When J&J's lawyer uttered those words, he had to know that J&J had decided to close the Lifescan facility and move the home office and factory to Wayne, PA.
