The Company must meet several requirements in order to satisfy the terms of the exception, including the consummation of the Company's restructuring. The Panel reserves the right to reconsider the terms of its exception in light of any circumstances it deems appropriate. The Panel's decision may also be subject to review by the Nasdaq Listing and Hearing Review Council, which may affirm, modify, reverse, dismiss or remand the decision of the Panel.
