DECN dismissed literal infringement themselves. DoE is a much bigger and faster way and could lead to a reasonably quick settlement. The word "literal" is important.
If DECN had to fight a literal patent infringement they would be fighting for 3 more years with several trips to the Federal Circuit court (1 for each side).
This is a good thing. It means a short schedule toward possible settlement.
