First, I believe the BNP is patented in some of the EU. In reading the USPTO actions it's obvious it wasn't getting a patent in the US after final rejections. As for the impact of that situation, many companies sell non-patented technology and sell it well. The patent on PCR technology ran out years ago before the technology actually took hold and now there are many companies selling it without patent rights.
Regarding the other two patented technologies sold by Nan0Logix, I and others here have heard that Mr. Barnhizer will only sell the FlatPack and N-Assay technology if someone buys the company, to go with the company, so that would indicate there is a connection between the technology and the company and a desire to do the "right" thing by us and for himself.
The usual yahoos here will argue against that premise, but that essentially demonstrates that they are cheap cheating AH's who would shaft anyone and expect others to behave the same.
As for Dr. Faro's ownership, since Mr. Barnhizer is the first inventor, that ownership is worth a share of whatever royalty there is or will be, but control of the patent is with the first inventor.
I don't see NanoLogix as going on the auction block, although it would not surprise me to see a bidding war for purchase after the import of the technologies becomes obvious. First I'd expect fairly large market purchases to indicate interest.
