DECN is spreading all over the face of J&J....unfortunately for J&J their is no cure.
An excellent choice of words. So, lets visit a few facts and a sprinkling of speculation.
The DECN victory in court over J&J last March was totally unexpected. J&J's pleadings were compelling. New handles sprung up here to tout these pleadings. The problem was, the judge didn't buy the pleadings, even as he admonished them for not following court rules trying to turn a Motion for Dismissal into a Summary Judgement motion in disguise. That IMO is a big thing.
But there are also little things. For example, J&J dismissed Unistrip from two lawsuits, one filed in Pennsylvania Federal Court, another filed in North Carolina Federal Court. I asked myself why would J&J dismiss Unistrip when they were going to win (and J&J was winning in a rout)? Answer! J&J could not beat (= destroy) DECN by themselves. So, the next best thing to confronting DECN was to enlist a little help. Unistrip is pretty much finished in the U.S. markets, but they are not finished in Europe where reputations are slower to take shape -- nobody has died yet in Europe from using a Unistrip or Prodigy test strip, although very few have bought them. So an unshackled Unistrip would provide that small amount of help to J&J, at least until DECN adds Unistrip to the Las Vegas court case.
And that makes DECN more than just a pimple.
