STRIKEFORCE TECHNOLOGIES, INC., Plaintiff, v. VASCO DATA SECURITY INTERNATIONAL, INC. and VASCO DATA SECURITY, INC., Defendants. Civil Action No.: 1:17-cv-10423-RGS STIPULATION OF DISMISSAL Plaintiff StrikeForce Technologies, Inc. (“StrikeForce”), defendant Vasco Data Security, Inc. (“VDSI”), and defendant Vasco Data Security International, Inc. (“VDSII”), hereby stipulate to the voluntary dismissal of defendant Vasco Data Security International, Inc., without prejudice, pursuant to Rule 41(a)(1)(A)(ii), Fed. R. Civ. P. The parties hereby further represent and stipulate as follows: 1.VDSI sells two-factor authentication products in the United States, including those branded as IDENTIKEY and DIGIPASS, that are accused of infringement in this action (the “Accused Products”) (see, e.g., Complaint, ¶ 19); 2.VDSII wholly owns VDSI, and does not itself make, use, offer to sell, or sell the Accused Products in the United States, or import into the United States the Accused Products, nor does VDSII encourage, instruct, or promote third parties to do the same with respect to the Accused Products; 3.VDSII agrees that, solely for the purpose of discovery in this action and to facilitate this dismissal, any documents and information in its possession, custody, or control will Case 1:17-cv-10423-RGS Document 21 Filed 05/12/17 Page 1 of 3
be produced in response to discovery served on VDSI, as though VDSII were still named as a defendant in this action, and without requiring StrikeForce to separately subpoena requested information from VDSII. 4.VDSI and VDSII represent and agree that any judgment in this case against defendants would be satisfied by VDSI Dated: May 12, 2017
