IHUB will lose this same argument.
When a website knowingly hosts illegal content or is made aware of illegal content on their website, they cannot throw their hands in the air and say that cannot do anything about it. It's not their fault or job.
WRONG!
SEC violations should ALSO be a TOS violation on their site. They cannot say that they are only bound by their own TOS and exempt from federal laws.
If IGLOW posted pics of him playing naked with an 8 year old boy on IHUB, don't you think they would pull it or would they let it stay? Federal law supercedes their TOS.
They have to follow federal laws, just like any person or business. Many of us have written to admin on IHUB telling them there is illegal content on their site and they all came back with the same excuse that it's not their problem.
But they acknowledged that they were informed there is illegal content on their site and admitted they aren't going to do anything about it.
Again, Napster was the first big site to try that defense and they lost BIG TIME. IHUB is responsible for taking action if they are informed of illegal content but they hide behind their TOS as if that negates federal laws. It doesn't.
There are enough people, and now companies, that have been working with the SEC about this. I know of a few companies who are no longer using IHUB for advertising because when their PR gets posted, it's a call to arms for their stock manipulators to come out from under their rocks and attack the stock. The companies said it's a waste of money to pay them and the PR gets used against them.
We need to keep up pressure on companies to let them know this is happening. They have the legal resources AND the SEC will weigh a letter or call from company attorneys more than individual investors.
People use this tactic with TV shows and it works. Inform the advertisers and cut off the money flow.
I am in contact with PR people on a weekly basis informing them of how their companies are getting attacked and they are very unhappy about it. They have already looped in their legal people and pushing forward with a case against IHUB.
This time it's different. Criminals always think they are the smartest people in the room....until they aren't and it's when they are in cuffs. People way smarter than the IHUB cartel have been caught, and so will they. This is also a RICO case.
Madoff, Milken, and many others thought they were too smart to get caught. Let me tell you, these IHUB people aren't even half as smart as those guys.
