Although you are probably correct in that there won't be an 8K today technically it could come out anytime prior to the market opening and still be legal. We can't trade on the info until the market opens, so if there is something new it may still be published before the open. I'm NOT expecting anything but am hoping we secure some funding, interest, and investment into OWCP.
