Sen. Sasse Slams Dems: 'A Lot of Hyperventilating' About Gorsuch

Senator Ben Sasse (R-Nebraska) said it will be difficult for Democrats to prove that Supreme Court nominee Judge Neil Gorsuch is "out of the mainstream."

Senate Minority Leader Charles Schumer (D-New York) said recently that Gorsuch is "out of the mainstream" and cannot be an independent arbiter on the court.

"I heard a lot of attempts at hyperventilating," Sasse said of Democrats on the Senate Judiciary Committee. "I don't know what they have [on him]. The guy is a judge ... he knows what a judge is, and he's agreeable and pleasant."

Several committee Democrats, including Dianne Feinstein of California, lamented that Gorsuch was not Obama's nominee, Merrick Garland, and Patrick Leahy of Vermont said he was picked by "special interest" groups.

There are a "whole bunch of Democrats who frankly want a judge to be a super-legislator," Sasse said, adding that lawmaking is not their constitutional duty.

Sasse characterized Gorsuch as a man who would say to those lawmakers, "I'm not an emperor, I'm a judge."

He said many Democrats will vote against Gorsuch's confirmation, in order to appeal to their base or on the grounds of their own personal partisanship.

"Judge Gorsuch should be on the Supreme Court and Judge Gorsuch will be on the Supreme Court," Sasse said.
