Yes. JNJ required, as part of the settlement, that all results of the agreement were to be sealed. Placing the monetary part of this settlement into a legal trust fund appears to be a legal method of keeping it private.
But, at some point, taxes will have to be paid. How this is done, without public disclosure of the amount, will be interesting.
The judge allowed this part of the settlement. This was done at the request of JNJ, not DECN. JNJ was embarrassed. And rightly so.
DECN says the more important value of this agreement was in receiving "licenses to pursue JNJ test strip patents". I know this means we are now free to sell test strips, without JNJ interference. But I think it means more than that. Just not sure what.
