Shit, they really never had a chance with this, I thought they had a 2% but really they had 0%, big waste of time.
They reference a lot about improper filing and not enough information which after reading it makes me wonder why they would even file this.
Summary judgement is for when someone brings up a case without merit and not worth the courts time. This is a contract, far from the standards set forth for a summary judgement.
I have to admit that unless they were buying time this is pretty disappointing.
I do believe they will have a much better chance in open court but surprised a lawyer would have jacked up a summary judgement so bad. I would be curious if the attorney told HJOE they had any chance of a favorable outcome on this. If so I would fire my attorney and seek a new one. I am hoping this was part of a bigger plan but don't think it helped their case to receive a ruling against them prior to a trial.
Now they will have to answer all the findings in this as well as prove their case, "if" they used this as a template to see what the court would say without going to trial yet then it was pretty smart. They received a preview of what they need to prove without a final judgement. Please let that be it!
