Those Mako comments are a hoot. He's too cocky in them. I have no doubt he is an offshore entity in a country where he is completely safe. Maybe Russia? I doubt even the SEC will be able to identify him and even if they do there will be no recourse.
That or he knows that he has a bullet proof defense:
1. Op-ed that the courts rule is not fit to be used as source material to file a lawsuit.
2. Opinion spattered all over the article.
3. States true facts from which he draws incorrect conclusions (to devastating effect). Remember, stating false facts is the crime. Coming to incorrect conclusions based upon true facts is not. There is no such thing as an illegal idea and you can't be convicted of being a moron.
4. NNVC vs Seeking Alpha is the final nail in the coffin.
I still think nailing the MMs on technical trading manipulation and letting them slide in exchange for information is the best way to find any CEs in the US if they exist.
Mako will continue his escapades and the people who don't understand the law will continue to wait for justice that will never arrive. Just as they have for 18 months already.
