Reading both of these will give you an idea of why, despite being full of complete lies, these pieces are protected as opinion by precedent due to their venue and formula. In fact, I fear today Leo Ehrlich helped cement this notion of “fake news”. His comment in the press release “There’s a reason that the courts have ruled that Seeking Alpha is not a credible news source,” illuminates this point.
Rosen was wrong to initiate a suit based upon an opinion piece because it was an opinion piece. Seeking Alpha is a venue for op-ed not fact dissemination. Relying solely on an op-ed piece should result in Rosen getting smacked with Rule 11 sanctions. The flip side of that coin is that Seeking Alpha is op-ed not fraud news. We can't have it both ways.
I see so many posts on many boards wonder why Mako and AF aren't getting sued. The answer is in the links above. Again, I would love to hear someone point out why our case is different but the formula appears solid and I'm sure CTIX has gone over them with a fine-toothed comb.
