KBM wanted those shares!! That was their money maker. Even if the court sided with KBM how much additional could they be awarded? Courts are not going to give them 1000% interest, 100%? 50K? Since the original loan was paid in full with interest (so says the court filings by HJOE) how much can or will the court allow in additional?
Taking the share option off the table was a automatic win. We just need the court to make a decision.
Now if they have additional toxic loans out the court decision will make a difference with how those get settled out. If KBM gets hammered i would assume the other lenders will be more acceptable to closing out the loans with better terms and also putting i behind them.
