Tech: frustration and impatience are certainly understandable at this point, given the guidance of prior years. If sour sentiment leads to parsing each word from every source, then so be it. The gripes have to go somewhere. However, KR told you directly at the AGM that "it is time to make money," and I believe him based on his experience and my discussions with him. There have been reports of increased tanker traffic, and there is the recent Madison county feedstock deal. The DEC increased permit levels in late July, and with more throughput the petcoke removal system needed to be able to handle it, hence further adjustment.
Nothing happens smoothly or as expected with any start-up company, and especially not with a company that is a perceived threat to several competitors (think incineration and landfill operators). I have heard reports of obstacles being placed, and they have appeared to be from various directions, continuous, and obnoxious. It is for these reasons that a pronounced "quiet" has settled over the company, which should not be mistaken for "lack of progress." One of the reasons internal house counsel was hired and is working diligently is to prevent and/or counter such obstacles.
That said, I continue to feel very good about JBI's future, given the progress to date. To your specific concerns: "sec allegations entirely fabricated..."? No, I believe the sec thought they had an easy target, based on the kinds of "concerns" they were receiving on their hotline and perhaps elsewhere. IMO the sec's allegations are weak and I expect a settlement at some future date. As for JB stepping down, I prefer the phrases "strategic move," and "focusing on his expertise," both of which are for the good of the company.
A 2 hour drive and reaching out with a bit of humility might get you some of your questions answered. But parsing with irritation and a negative bias likely will not. The past cannot be undone, it is the future that counts.
Sorry I didn't get to say hello at this years AGM. I do travel a lot to developing countries and cannot always respond here. Perhaps next year.
