Dear Sirs :
Please be advised that our law firm has been retained by "Company Name" to take possible legal action against you in "Country" for the series of defamatory attacks made by you against them on the web site "yoursite.com" and their affiliated web sites.
You have posted many willfully false and misleading comments about my client. Some examples of your defamatory statements will be sent to you in my next correspondence. The statements made in reference to "Company Name" are false and without merit and are defamatory per se. Additionally, your comments and posts actively encourage and solicit defamatory statements from users of "yoursite.com" You could have serious financial exposure to "Company Name" for each and every single defamatory statement.
Your conduct of spreading libelous and defamatory statements and comments about our client have caused serious and irreparable injury to their business and reputation within the investment community.
While you certainly have a right to express your opinions, you do not have the right to make false statements of fact injurious to another’s reputation. The comments posted by you on "Company Name" go far beyond the mere expression of opinion. They are false statements of facts that have damaged our clients business and reputation.
THEREFORE, we hereby demand that you:
1-Immediately CEASE AND DESIST from making defamatory comments against our client on any and all web sites, including, but not limited to "yoursite.com"
2-Immediately delete or remove from "yoursite.com" and any other web site, all defamatory and disparaging remarks made by you against our clients.
3-Issue a letter of apology in writing to our client for the damages that your actions have brought upon them.
If you refuse to comply with our demands within 1 week of receipt of this letter, "Company Name" will have no choice but to pursue all legal claims against you, including the filing of a lawsuit. In that lawsuit, they will pursue not only damages caused by your actions, but attorney’s fees and court costs.
YOU DO NOT HAVE PERMISSION TO PUBLISH THIS LETTER ONLINE OR IN ANY OTHER FORM OF MEDIA.
