You're making assumptions about Comey's understand

You have a 'result' in mind that you want, fueled by amateur lawyers like yourself.
But the law doesn't start with the result and work backwards.
Inferences and deductions either lead to evidence sufficient for successful prosecution, or they don't.
Jeezus, how many TV shows have you seen where a prosecutor told the cops "I can't go to the grand jury with that, get me evidence that will hold up in court".
You opinion about the evidence simply doesn't count. And you wouldn't want a layman like yourself making the same assumptions about your guilt if you were the subject of a criminal investigation.
I know I sure as hell wouldn't want you making those assumptions about me in my criminal investigation, nor would I want you serving on the same jury with me.
