I do believe that they issued more shares to make the 4.00 PIPE effectively worth 2.00 (doubling the number of shares). I am just going from memory. So the damages would be reduced, but in considering damages you have to take into account that the shares are not liquid anyway (restrictive covenants).
At the end of the day... it does not affect how much money JBI got from the PIPE issue. A share is just a future promise of a return. No matter how many shares you have, unless promises are kept, you still have a loss, dependent on when you sell.
