I did a tiny bit of digging on that possibility right after Rosen filed the lawsuit. I was left with the conclusion that such a case would probably be a precedent setting case. I turned up examples of suing your own lawyer for negligence but was unable to find an example that would fit our circumstances. Would love to know if anyone here finds an example of shareholders receiving damages over a failed frivolous lawsuit.

"Just about all state and federal systems have penalties for filing truly frivolous actions, either in the form of an action for malicious prosecution or court-issued sanctions; the most common result is that the person filing a frivolous suit is ordered to pay the attorneys' fees and costs of suit incurred by the wronged party.
