Rosen will suffer losses, even if Sullivan agrees to drop the sanctions motion. Their losses will be the man-hours they've invested going down a dumb dirt road, hours that could've yielded millions by chasing a better sucker punch prospect than CTIX. And I think they'll end up paying at least part of Sullivan's fee, maybe most. So if we get lucky they're out of pocket how much on opportunity costs and payments to Sullivan? My swag would be $5 million, all in. Chunk of change, but...it's just business, right? Win some lose some. You say they're getting their asses handed to them, I say they might have a chipped tooth. Meanwhile I can't help but think what CTIX's value might be right now, and how much further the drugs might've progressed if those bastards hadn't shown up. That loss is in the $100's of millions, part of which is mine.
Then again maybe Rosen did long-term shareholders a favor, slowed things down 13 months ago, kept irrational exuberance and speculation from getting out of hand, and forced management (and the largest shareholders) to take a hard look at how they were staffed and structured and governed. With some luck and media attention in the past year, and without Rosen, CTIX might've had a $1 billion MC right now. Other lesser companies do. Meanwhile Krishna is scrabbling around in the lab of this suddenly-huge, NASDAQ-listed enterprise, hard-bitten institutional eyes are looking at the filings, Leo is issuing an upbeat PR every Tuesday at 10am that has a couple of syntax errors, and everything else including the occasional trial protocol is unraveling from the edges, too much, too fast. I like the new hires.

Wow, just wow. Allow me to present a parallel to the argument that you just made in that statement: If some rape victim had just not worn that short dress which enticed the boys at the party she was at, then she wouldn't have had the unplanned baby which ultimately made her the awesome single mom that she is today. Thank god for the @sshole that did the raping. Otherwise we might not have ended up with such a strong person who managed to persevere through an undue hardship. Nevermind the derailed potential to achieve much more without having that unplanned roadblock.
