The precedent was that the Supreme court determined that the suit belonged in State court. The Supreme Court made no determination on the nature of the actual suit.
The precedent is that a plantiff is no longer limited to suing in Federal Court. Therefore if an MM is registered in 23 states, a plaintiff can sue the MM in all 23 states AND in Federal courts.
The precedent relates to jurisdiction not Naked Shorting nor Spoofing.
RICO criminal charges and would be levied in Federal Courts. Make no mistake: Price fixing is a federal criminal racketeering charge. If you are involved you might as well be in the Mafia. If you conspire with a group place ANY commodity at ANY price, up or down, that is price fixing. It is a criminal act and RICO applies as soon as one buyer and one seller are from different states (transaction crosses state lines). I don't know if I can be more clear than this.
