We need to trust our leaders, love, and respect their decisions .
Over the past few days, some media speculation has led members of the local community to wonder if the Islamic Center of Irving is facilitating “Shariah Courts” at the Mosque. The management of the Islamic Center of Irving categorically declares that no such court operates on the center’s premises. No other mosque in the area operates such courts. However, the Islamic Tribunal that operates in the Dallas-Fort Worth Metroplex, independent of the mosques, to address a genuine need within our faith community for intra-community arbitration.
Islamic Tribunal (IT)
Article 1
The objective of this Court is to resolve any dispute among Muslims residing in USA while complying with the federal laws of the United States and Texas state laws under the approval of the Texas Judicial system.

Article 3
The IT shall apply the principles of KITAB, SUNNAH and Islamic jurisprudence (FIQH) to solve the problems without adherence to any spastic school of thought (MADHAB)
Article 4
IT is a non-profit organization registered by the state of Texas.
Article 5
Board of Directors of IT will consists of: President, vice president, secretary, treasurer, and one member.
a. The Board of Directors shall have full authority to manage the IT including administration and operations, with simple majority quorum.
b. In the event of a tied vote, the president shall have two votes.
c. The founders of the IT shall be the first Board of Directors.
Article 6
a. The Board of Directors of IT may amend the constitution upon a 2/3 majority vote of, in favor of change.
b. In the event of a tie, the president shall have two votes.
c. In case of a membership opening on the Board of Directors, the remaining members may elect a new replacement member upon a 2/3 vote of all membership.
Article 7
The judges of IT must have a degree in Islamic law approved by a renowned Islamic institution.
Article 8
a. The clients must comply with the IT administrative procedures when requesting IT services.
b. The clients must submit a written brief of the conflicts.
Article 9
In case one of the parties is absent, the IT shall work diligently following Texas civil procedure to protect the rights of the absent party.
Article 10
a. Upon the acceptance of the application, the IT will assign one judge from the approved list of judges by the board.
b. All cases will be managed according to the internal procedures established by IT
c. A panel of three judges will be present along with an advisor lawyer when the decision will be made.
d. IT secretary will take summary notes dictated by the presiding judge.
Article 11
IT judges and employees will be paid according to the system fixed by the IT Board of Directors.
Article 12
a. The decision of the IT will be final according to Islamic jurisprudence (Fiqh).
b. The decision will be presented to the relevant court for authentication according to the law of the land.
Article 13
The IT decision could be subject to appeal by either party or both parties to the relevant court of law.
Article 14
In case of dissolution, remaining assets will be distributed to IANT, ICI, and IACC equally.
Article 15
To prevent issues of conflict of interest future compensate, on of any officers and employers must be voted on by the board.
Article 16
The founders of the IT shall consist of the followings:
1. President: Imam Yusuf Ziya Kavakci, Ph.D.
Scholar in Residence / Imam Islamic Assoc. of North Texas
2. Vice President: Imam Moujahed Bakhach
Director of Mediation Institute of North TX.
3. Treasurer: Imam Zia Sheikh, PhD

4. Member: Dr. Taher Elbadawi
