I don't know the benefit of filing now GRD especially if HJOE shows net losses over the previous two years, which could negatively impact their case. I'm sure they don't want any questions to arise from filings in court. It's already a slippery slope both companies are climbing by bringing suit. Court is a crap shoot, and I can't see the company muddying the waters by filing and allowing KBM to question anything further.
On the flip side, should HJOE file, I'd be hard pressed to think that KBM would convert which could bring more potentially dirty actor actions against them in court and prove HJOEs case. I honestly don't know what the hang up is, but do know as far as PPS goes, it won't go anywhere until this case is settled. That is a good thing for some who wish to accumulate and for others who are impatient, they'll move along. Personally, I'm ambivalent at this point as I'm not going anywhere until they settle matters.
