I've been involved in Summary Judgment before and

I've been involved in Summary Judgment before and it's not so simply achieved while both parties are claiming there is a genuine dispute. One of the rules for a SJ is that one party has clear evidence that no dispute exists. I don't see that here. I believe KBM, wrong or not, have laid claim that a genuine dispute exists. I don't agree with them, but from reviewing other cases, there are a couple that are advancing toward trial. The rest- voluntarily dismissed by KBM or settled. I've yet to see them win one, and yet to see a reverse prosecution against them This is new territory for KBM as a defendant, and I do not think this judge will hand out a summary judgement. Take a look at the disposition of most of the cases filed by KBM. No summary judgments. Mostly voluntary dismissals.
