I read the KBM response in full and need a rebuttal to this one legitimate question. In the five transactions HJOE did with KBM, the first four met with no objections and HJOE honored the conversions. (BTW, it looks like KBM made millions off of that and summarily buried the PPS (if I'm reading the sums right)), so why balk on the final loan? That is KBMs contention. They honored the first four now claim usury on the fifth. Why?
I'm certain there is a response to that, I just can't think of it as I looked at the exhibits from KBM and they were honored. That is a concern I have for how this might shake out in front of the judge.
