I hear ya, but remember that most who would do that already are, and driving while impaired by THC consumption won't come with any less severe penalties, once legalized, than they do now once a breathalyzer or blood test verifies the driver was indeed impaired. Especially if injury or death results, cause these days unless your wealthy or have connections to make the evidence disappear or be altered, the book will be thrown at you and hard. The penalties for smoking it even now aren't that severe, so the big penalties are only stemming from large scale distribution and negligent operation of motor vehicles and/or reckless endangerment as in the welfare of a child. It's just my opinion, but I believe most of those who would do that already are, cause the laws against just using MJ aren't that harsh. They're working hard to maximize the accuracy/consistency of breathalyzers for law enforcement and businesses in order to quickly and accurately determine if an individual has non-significant trace amounts of THC in their systems or if their impaired from recent use. Those thinking they can get away with it will more and more often be in for a rude awakening.
