"Help me understand why if I'm wrong. I'm in Engineering not Law so I'm learning here.

First thing you have to do when dealing with the courts is remove logic, objectivity, and rationale. My attorney said that to me repeatedly as he knew me well prior to becoming my attorney as I coached his kids and am a ChmE. He constantly cautioned my about applying any of the above and never assume they will be employed by a judge. The strongest cases can be eviscerated by a technicality or a bad judge.
If KBM provides no specific rebuttal and $HJOE is laden with facts/data and hopefully for us a lot of documentation we arent privvy too - it is possible it will be granted but it will be difficult. Again, the attorneys must feel the evidence is compelling enough to tey ornelse they risk admomishment from the court and that is not how you want to go into a trial.
