long story short - even with the best case - it is still a crapshoot. odds are definitely in one's favor when they have the preponderance of critical evidence. i do believe $HJOE is in that position but it will depend on how its argued and how much "weight" the judge puts behind HJOE's continuing to use toxic debt instruments while being hosed by them. if she agrees that the actual death spiral created PREVENTED them from doing anything else and it was a last means resort to survive - than the usury claims and actual returns by KBM (capital, interests, trading profits from conversions) will be taken into more careful consideration. if KBM counsel believes the judge is leaning that way at all - or even on the fence - they are best served in counseling their client aggressively to settle and make this go away.
