I don't think we have to wait for criminal charges that may or may not come. (I don't have much faith in the SEC.) If Judge Failla grants sanctions that is a pretty strong prima facie case right there. Criminal charges would be great, but they would need to be fully adjudicated (with convictions) to be of much use in a civil suit. (Although the evidence used in that criminal trial could probably be used simultaneously in a civil suit.) But then you might need the cooperation of the prosecutor to pull that off.
I am looking forward to the civil suit because that is where Rosen, Kim, Stern, and Zagami (as well as the first plaintiff who you will recall withdrew her complaint) will be deposed under oath. Are they all going to lie? I don't think so. Rosen will NOT want those depositions to take place. In fact, I really hope that Sullivan has already "interviewed" that first plaintiff. I think is going to get good!
