No lawyer here, but I did not see where the judge specifically mentioned "with prejudice". However I believe the wording the judge used was indeed a de facto "with prejudice" ruling because she stated that even after a chance to amend the complaint is without merit. They could refile, I believe, but the crap they have been using so far is not going to get the job done.
