It was a very quiet week X10, with minimal fluctuation. Very little capitulation going on with a lot of people holding firm. Volume looks like lots of little flips or cash outs to get into other plays. We're in an extended holding period,
I agree. Motions should be very interesting in two weeks. With everything I've been reading with the DD and prior KBM cases, it looks like none have gone to trial.. Like jmcblacksheep, I'm wondering if the judge will simply say, take your 64k and take a walk. I find it hard to believe that this judge will award KBM 140% interest and 2K per day in penalties when it is hard to fathom the harm to Kramer? If he states that the harm is he didn't get his shares to further dilute the market and make millions more, I'm not sure that won't be laughed out of court. Doesn't seem like a sound play. If the complaint is they want their interest and penalties that seems like another dead end play. So I'm scratching my head to see where the harm is for KBM?
We can definitely find a counter where there would be harm to HJOE should they turn over millions and millions of shares. Let's be honest, KBM isn't after 64K, or I'm sure HJOE would have written the check and said see ya.
