That being said, I don't think it's a strong complaint, but I still believe it is what they will argue. On the other hand, I think HJOE, and this is a pure gut feeling, has something else on KBM. Compelled to hire a dirty auditor? They allude to it in their response. Emails promising assistance with paying back? They allude to KBM offering assistance in paying back. Can you imagine if HJOE comes to court with concrete evidence in the form of emails that prove that KBM told them, "not to worry about the interest rates," and, "we will help you repay the loan." If that were me, I'd have to go on that good faith and it's something else they allude to in their counter claims.
I don't think any of the above scenarios are wild wishful thinking when it comes to loan sharks. If any are real, KBM is finished.
