The appellate courts decision is a great find, and your right if hjoe wins then KBM will most likely be facing criminal charges. Without knowing the rules of court for that district, would a judge allow this to proceed to trial based on prior court decisions, especially the appellate courts decision ? I don't think it's that's easy by far, and I don't think our lawyers do either or I'm certain we would of seen a filing for summary judgement based on the appellate courts decision. Either way if we don't see DOCS tomorrow or the day after with a court date, then I think we can safely assume that it's been settled. If a court date is filed then at least we will have a time line.
