I am from the New York area, but typically the first hearing, and as far as PACER terms it, this is a mediation hearing, there is nobody but the lawyers, judge/mediator and both parties present. I've been through this and can tell you, the judge/mediator is very good at stating the specific law, paints the scenario and is persistent in recommending good faith settlement. There job is to keep these types of things out of their courtroom and they will be resolute in attempting to do so. Generally, the pissing contest stops once things get in front of a judge. If this particular judge has experience, which I am sure he/she will, and doesn't take kindly to usary and tortious interference claims, KBM may pack up their tents quickly.
