A jury simply interprets the law as presented by the judge and his/her directions and determines guilt or innocence based upon a set of criteria. They will not determine any compensatory or other damages. That will be the judge. If we have a judge who is experienced in these matters, which I am sure that person will be, compensatory can be anything the judge wishes to apply, based upon past precedence or simply setting a new precedence.
KBM is taking a huge risk in having this go to trial. Their hands are dirty and it won't be something any judge takes kindly too, IMO. According to HJOE, they've made their money +++ and a judge may not take kindly to them trying for more while taking Joe's knees out.
Do not be surprised if Joe pushes for trial and goes for the jugular while KBM cries like a bitch and seeks the settlement that HJOE (according to them) already offered.
Nothing is guaranteed in court, but I do think the greater risk here is KBMs.
