We also have in there the part (b) of what is to be retained, and that is because in

negotiations that we had with all of the settling parties, with the equity committee

last week, with the FDIC, we did talk a great deal about the concept of the retained

assets. Now, it's my position, Your Honor, that the examiner doesn't need to do

much with the retained assets other than say the assets are retained and therefore

the liquidating trust can go ahead and pursue them. They will still be there; they

can be carried through. But I understand that the equity committee is very

interested in having a neutral third party do an investigation of those retained assets.

jb92106, remember one thing that keeps getting passed over. In 9/2008, it was illegal to seize a bank holding company, so seizing the holding company of WaMu was illegal. Now, we have all of that value coming back.

I find it amazing, that so may important facts like this one can be overlooked along with the P&AA itself shows there is value coming back. The bankruptcy law was actually lobbied by Sheila Bair and then changed to allow the seizure of bank holding companies NOW but NOT in year 2008. This act in-of itself should be very telling
Hopefully the escrow dreamers have been loading $WMIH. That's where the money is, not escrows.


It might be a good idea to load. The instys are, might be smart to join them.

For the escrow Dreamers. You have gone to great lengths to provide reference to and links to all the documentation to support what is happening, but many seem not to want to read the documentation or if they do, still choose not to believe what has been clearly disclosed. Still, I have not seen any answer to explain why there haven't been any challenges by any party. That IMO, is pretty convincing evidence that no assets are missing.
