The matter of the Baltia’s application for the issuance of an air carrier certificate is currently pending in the FAA Office of the Chief Counsel, Enforcement Division. On November 16, 2015, FAA legal counsel issued a Notice of Proposed Denial, proposing to deny Baltia’s application for an air carrier certificate. On December 1, 2015, Baltia’s legal counsel, Marshall Filler, responded to the Notice on behalf of Baltia, and in accordance with the procedural requirements in 14 C.F.R. § 13.20 requested an in-person informal conference to discuss the matter with FAA legal counsel in Washington, D.C. The informal conference was held on December 16, 2015. In consultation with the Office of Aviation Safety, FAA legal counsel is currently evaluating the information presented by Baltia at that informal conference together with all of the information concerning the demonstration phase of Baltia’s certification project. FAA legal counsel will advise Baltia’s counsel of the decision reached as a result of those internal deliberations once they have concluded.
