Besides, if they want to crush the shorters, just declare another dividend right now. Hell, do the .27 buyout right now, that will crush the shorters, no need to worry about any of this other stuff.
If there is a massive short, there is no need to prove it, just declare a dividend like they did before, pay the real shares the .01 or whatever, and the DTCC will debit the shorters. Problem solved. They could have done this already, no?
I am just not seeing a reason why they would wait to do this when they can stick it to the shorts with a dividend this minute if they wanted to. The current litigation would have no impact on that either way.
