Sure, who's talking about criminal charges? Of course this is a civil suit. COR is the one who filed it.
There is no SEC court; they're a regulatory body. However, that wasn't the question. The question was, why would COR expose themselves to further penalty by loudly trumpeting that something fraudulent was happening if they were the ones doing it?
