Let's look at the Judge's actions so far.
1) Rosen ask for permission to file a second amended complaint and Sullivan opposes it. Result - Rosen gets exactly what they asked for.
2) Rosen ask for additional days to file said second amended complaint and Sullivan opposes it. Result - Rosen gets exactly what they asked for.
3) Sullivan ask for permission to file additional pages with his motion to dismiss. Rosen does not support or oppose it. Result - Sullivan does NOT get what he asked for. Instead of 15 additional pages, he only gets 5.
Based on the above, it appears that Rosen is getting better treatment from the Judge than she is giving Sullivan.
The reverse argument is that she is granting Rosen's requests in order to limit their issues on appeal. And she ruled against Sullivan because she does not want to read the additional pages since she plans to grant the motion to dismiss.
We shall see...
