Just looked back at your quote from BK. I believe you may have added the words (non-public) to his comments incorrectly. As I remember the quote about who chose the lawyers, for instance, was a PR from the former CEO that was pasted on the message board.
Its an interesting thought about Aruda possibility trading on non public info though. The fact that he is not (an insider) to my mind should make no difference because the golfer in my example was not an insider but couldn't trade on that knowledge. It's an interesting question for sure. Remember the lawyers likely got 2 million shares. You think they haven't sold? One would think they know the law pretty well.
